US settles claim against IT firm for discriminating against American workers

January 13 -- The US department has announced that it has settled the claim with an IT staffing and recruitment company for discrimination against American workers. The US Department of Justice had alleged that Ikon System discriminated against US workers. On Tuesday, the Justice Department accused Ikon Systems of routinely discriminating against the US workers by posting job advertisements inviting only temporary work visa holders to apply. The company filed to consider at least one US citizen applicant who applied to the advertisement. Eric Dreiband, Assistant Attorney General of Civil Rights Division said, "Employers, no matter their size and no matter their industry, cannot limit employment opportunities only to temporary visa holders. When employers post job advertisements that discriminate against US workers, they violate the Immigration and Nationality Act's (INA) citizenship-status discrimination provision." The US Justice Department is clear that if the employers discriminate in advertising, recruiting, or hiring against US workers, the Justice Department's Civil Rights Division will act to protect them under the Immigration and Nationality Act. The 11th settlement by the Civil Rights Division under 2017 Protecting US Workers Initiative aims at targeting, enforcing, and investigating actions against companies that discriminate against US workers. The investigation against Ikon Systems started when a US citizen filed a complaint. The department concluded that Ikon posted eight facially discriminating job ads targeting non-US citizens. One of the job advertisement stated 'Looking for OPT, CPT, H4 EAD, and H-1B transfer.' H-1B visa is a non-immigrant work visa program that allows US businesses to hire foreign workers in speciality occupations. The US issues over 85,000 H-1B visas each year. Most of the H-1B holders in the US are from India and China
