Heard learned Senior Advocate Mr.N.D. Nanavaty assisted by learned advocate Mr.Yuvraj G. Thakore for the petitioner and learned Additional Public Prosecutor Mr.D.M. Devnani for the respondent State.

Learned Senior Advocate has, at the outset, pointed out that the petitioner has challenged the order dated 17.03.2020 passed below Exhs.1 and 5 in Special Case (Companies Act) No.1 of 2020. It is submitted that non­bailable warrant has been issued against the present petitioner. It is pointed out that the co­accused Rajiv Kirtibhai Kothari has also challenged the said order by filing Special Criminal Application No.6047 of 2020. The co­ordinate Bench of this Court vide order dated 20.10.2020 has issued Rule and granted protection to the said co­accused. The case of the petitioner is also similar.

R/SCR.A/4115/2021 ORDER DATED: 08/06/2021 In view of the aforesaid submissions canvassed by learned Senior Advocate for the petitioner, issue Rule returnable on 26.08.2021. Learned Additional Public Prosecutor waives service of notice of Rule for the respondent State.

In the meantime, the impugned order of issuance of non­bailable warrant against the present petitioner passed by the concerned Special Court vide order dated 17.03.2020, qua the present petitioner, is stayed.

To be heard with Special Criminal Application No.3988 of 2021.
